Specific Acceptable Use Policies
Server abuse
Any attempt to undermine or cause harm to a server or service utilized by Canadian Creative Web Services or any other client accounts is strictly prohibited.
Canadian Creative Web Services will strongly react to any use or attempted use of an Internet account without the owner’s authorization. Such attempts include “internet scamming” (tricking other people into releasing their passwords) password robbery, security hole scanning, or any other misleading or fraudulent act.
Any unauthorized use of accounts by a Canadian Creative Web Services client, whether or not the attacked account or shell belongs to Canadian Creative Web Services, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack.
To maintain the integrity of our service the following limitations apply:
The Canadian Creative Web Services Administration will be the sole arbiter as to what constitutes a violation of these Terms of Use.
Commercial Advertisements with E-mail Canadian Creative Web Services clients may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Advertising sites on other servers which in turn contain links to a domain on Canadian Creative Web Services’s service is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and E-mail. If you are found to be using your account for spamming, we will contact you to resolve the situation. If it is a severe case then we will immediately, without warning, disable your domain until the situation is resolved. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy. As such, any violation will result in immediate deactivation of services without refund.
Payment Policies
All accounts are set up on a pre-pay basis. Domain Registration fees are non-refundable. Setup fees are charged for all new accounts and major account changes and are non-refundable. All pricing is guaranteed for the term of pre-payment. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Canadian Creative Web Services in writing for a request for termination of services. All payment is in U.S. currency.
Bandwidth Overages
Any bandwidth usage over and above the limits set out in client accounts will be charged at the rate of $ 0.75 per gigabyte, and must be paid in full at the next billing cycle to prevent disabling of client account. Extra bandwidth may be added to any account as a package add-on as listed in the Client Care Centre.
Overdue Accounts
Any Client Accounts not paid in full within 7 days of invoicing will be considered to be overdue and run the risk of becoming disabled, and will remain as such until the account is paid in full to Canadian Creative Web Services. To avoid disabling of your account, please be sure to pay your invoice on time. Continued non-payment of an account in arrears will result in the cancellation of the account and may result in the loss of any data you may have contained in your server files.
Accounts found to be 7 days past due will be charged a 10% overdue fee, which must be paid in full prior to account reactivation.
Cancellation
Canadian Creative Web Services reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by Canadian Creative Web Services if Canadian Creative Web Services institutes its right of cancellation. Any violation of policies which results in extra costs will be billed to the client (i.e.transfer, space etc.)
Lawful Purpose
Canadian Creative Web Services reserves the right to refuse service to anyone. Clients may only use Canadian Creative Web Services’s services for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material (including but not limited to music files, e-books, and motion pictures distributed without written permission and not the original composition of the hosted site’s owner), material legally judged to be threatening or obscene, and material protected by trade secrets. Canadian Creative Web Services expressly forbids anyone from using Canadian Creative Web Services services for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, or any other material which we deem to be objectionable, including, but not limited to, pornography, satanic materials, and any and all materials of an adult nature. The designation of any materials as such described above is left entirely to the discretion of Canadian Creative Web Services Administration.
Indemnification
Client agrees that it shall defend, indemnify, save and hold Canadian Creative Web Services harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Canadian Creative Web Services, its service providers, agents, customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by a client, its agents, employees or assigns. Client agrees to defend, indemnify and hold harmless Canadian Creative Web Services against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Canadian Creative Web Services’s services and its service providers; (2) any material supplied by a client infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to a Canadian Creative Web Services client’s customer while hosted through Canadian Creative Web Services’s services.
Disclaimer
Canadian Creative Web Services will not be responsible for any damages a Client’s business may suffer. Canadian Creative Web Services makes no warranties of any kind, expressed or implied for services we provide. Canadian Creative Web Services disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Canadian Creative Web Services and its employees. Canadian Creative Web Services reserves the right to revise its policies at any time.
Failure to follow any term or condition will be grounds for immediate account deactivation.
