1. Acceptance of Terms

By accessing or using Canadian Creative’s webhosting and IRC hosting services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use our Services.

2. Eligibility

You must be at least 18 years old or have legal parental/guardian consent to use our Services. You agree to provide accurate and complete registration information.

3. Services Provided

We offer:

  • Shared, VPS, and dedicated webhosting
  • Domain registration and DNS management
  • IRCd hosting (including UnrealIRCd, Anope Services, and related tools)
  • Email services (Exim, SpamAssassin, etc.)
  • Technical support and server management

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your credentials
  • All activity under your account, including IRC channels and bots
  • Ensuring your content complies with applicable laws and these Terms

5. Acceptable Use Policy

You agree not to use our Services for:

  • Spamming, phishing, or distributing malware
  • Hosting illegal content or IRC networks used for criminal activity
  • Denial-of-service attacks or IRC flooding
  • Circumventing network restrictions or engaging in unauthorized access

IRC-specific restrictions:

  • No open proxies or TOR exit nodes
  • No unauthenticated relays or public botnets
  • IRC services must comply with Canadian law and international norms

6. Data Privacy

We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA). See our [Privacy Policy] for details on how we collect, use, and protect your data.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance and unforeseen outages may occur. IRC services may be subject to additional latency or filtering based on abuse mitigation.

8. Payment and Billing

  • All fees are listed in Canadian dollars (CAD)
  • Invoices are due upon receipt unless otherwise stated
  • Late payments may result in suspension or termination

9. Termination

We reserve the right to suspend or terminate your account for:

  • Violations of these Terms
  • Abuse of network resources
  • Non-payment or fraudulent activity

You may cancel at any time. No refunds are issued for prepaid services unless required by law.

10. Limitation of Liability

We are not liable for:

  • Loss of data, revenue, or business due to service interruptions
  • IRC-related disputes, bans, or network fragmentation
  • Third-party software vulnerabilities

11. Indemnification

You agree to indemnify and hold harmless Canadian Creative, its affiliates, and staff from any claims arising from your use of the Services, including IRC-related activity.

12. Changes to Terms

We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia and applicable federal laws of Canada. Disputes shall be resolved in the courts of British Columbia.
